TERMS AND CONDITIONS

TOUR FARE

Tour costs include air transportation and land arrangements that are subject to change without prior notice, unless the deposit or final payment has been paid. Tour prices are quoted in US Dollars.

RESERVATION, DEPOSIT AND FINAL PAYMENT

Deposit for reservation is $300 per person. More deposit may be required for some specially designed tours. All deposits are due within 7 days as of the reservation date if departure is 70 days ahead. Final payment must be received by Yangtze Cruises, Inc (hereafter referred as YCI) 60 days prior to the departure. Failure to comply with these deposit and final payment requirements may result in automatic cancellation of your reservation.

PASSENGER PROTECTION PLAN

YCI strongly recommends the purchase of travel insurance. It protects you against financial losses you would incur in the event of illness, injury or death of you, a family member or a traveling companion.

LAND ARRANGEMENTS

Costs of land arrangements are subject to change if exchange rates fluctuate, unless deposit and final payment requirements are met. Land price is based on two persons sharing a twin bedded room. The single supplement room rate usually covers all cities on the tour except any involuntary stopovers as provided by airlines or otherwise agreed upon between the traveler and YCI. Land only participants are responsible for their own international air transportation, including into and out of the destination air arrangements. If arrival and departure transfers are needed, they should be purchased separately. Airfare within the destination is included in land only price.

AIR TRANSPORTATION

Air transportation is based on round trip economy class and subject to the terms and conditions of the airlines. YCI reserves the right to substitute other scheduled airlines if necessary. Any fare increase by the airlines will be added to the tour price and be borne by the passenger unless the air tickets have been paid and issued.

HOTEL ACCOMMODATIONS

Most accommodations will be provided in hotels specified in the itineraries, except some special tours to the grassland, or mountain areas. YCI reserves the right to substitute hotels whenever necessary. All hotel rooms are randomly assigned by each hotel on a run-of-the house basis.

YANGTZE RIVER CRUISE

Yangtze River cruises are by standard cabins, double occupancy, unless otherwise booked and paid. In the event that an assigned cruise ship is not available due to the reason beyond the control of YCI, YCI reserves the right to substitute with any other available ships.

MEALS

Meals are served three per day in China with western style breakfast and Chinese lunches and dinners, and daily breakfast in Hong Kong. Other destinations may vary. Voluntary non-usage services are neither refundable nor exchangeable. Special requests should be noted at time of booking.

DOCUMENTATION

Each passenger is responsible to obtain his own proper documentation for the trip. A passport valid for 6 months is required. Visa is needed for entering and exiting China. Visa requirements in other destinations vary. Visa fee is not included in the tour price. Non- US passport holders will have to pay a surcharge for the visa.

BAGGAGE

Airline regulations entitle each trans-Pacific passenger to two check-in suitcases and one carry-on bag that will fit beneath the seat. Please check directly with your international carriers for details.

SIGHTSEEING, TRANSFERS POTTAGE AND TIPS

All sightseeing and transfers will be conducted in air-conditioned private motorcoaches whenever there are 15 or more passengers available. For less than 15 passengers, scheduled (seat-in-coach) sightseeing and transfer services may be used. Custom designed individual tours will have private cars or motorcoaches. All arrangements in China are handled by government owned travel services and are subject to change at any time. Due to occasional flight delays, some sightseeing tour might not be able to be conducted as scheduled. Tips to local and national guides are not included and are expected.

TOUR DIRECTORS AND LOCAL HOSTS

When there are 15 or more fully paying tour members, a Chinese national guide will travel with the group throughout Chinese mainland. For less than 10 members, the tour will be locally hosted, which means there are no guides on the planes or trains between cities.

NOT INCLUDED

Any extra transportation which is not part of the itinerary, tips to the drivers and guides, passport or visa fees, insurance, foreign airport charges and taxes, municipal development fee in some cities, US international departure tax, airport taxes, immigration and customs fees. Also not included are airport portage (unless otherwise stated), excess baggage charges, hotel portage, additional meals, beverage, laundry, telephone/fax, and other items of personal nature.

CANCELLATION PENALTIES

All cancellations shall be received by YCI by writing or Facsimile. The following penalties will apply based on the time prior to the departure:

* Certain tours offered by some tour operators on this web site might have stricter requirements for their special departures. To fully read the itineraries and to carefully check the terms attached to the tour are repeatedly suggested by YCI.

CHANGE, LATE BOOKING FEE AND REFUNDS

A fee of $50 per person per change will be applied to any changes made after the booking has been confirmed. Bookings made within 30 days prior to departure will be assessed $50 per person. Any portions of the land arrangements, hotel accommodations or any other service or feature of the tour which are not used are neither refundable nor exchangeable. In the event that tour participant falls short of minimum number of passengers, the tour participant will be offered alternative departures or full refund. Such a full refund shall constitute final settlement with the tour applicant. All claims for refunds must be made through the booking agents from whom the tour has been purchased and within 30 days after termination of the tour. No refund will be made for complimentary accommodations and services provided by the airlines for involuntary stopovers. No refund will be made to travel insurance premiums and visa handling fees.

RESPONSIBILITY

Yangtze Cruises, Inc organizes, promotes and sells tour programs consisting of such services as air and ground transportation, sightseeing and hotel accommodations, all of which YCI acts as an agent upon the express condition that YCI shall not be liable for any injury, damage, loss, accident, delay or irregularity which may be occasioned either by reason or by defect in any vehicle, or through the act or default of any company or person engaged in conveying the passenger, or in carrying out the arrangements of the tours, or otherwise in connection therewith, or of any hotel proprietor or services, sickness, weather, quarantine, strikes, force majeure, other causes or acts of God. All tour itineraries and prices may be affected by alterations in cruise ships, air, highway transportation and railroad services of the destinations due to the above said reasons. If such a change results in a lower price, YCI will refund the difference; if such a change causes extra cost, it will be born by the tour members and collected on the spot. YCI reserves the right to withdraw a tour, substitute hotels, and make alterations in the itinerary as deemed necessary to the better carrying out of the tours. The Chinese handling agencies reserve the right to make alterations or adjustments in the itinerary as to destination, transportation, accommodations and all other services. YCI reserves the right to decline any person as a tour member whenever it thinks necessary. At such a case, a full or equitable amount refund of the payment by the tour applicant shall constitute a final settlement. The airlines concerned are not held responsible for any act, omission or event during the time the passengers are not onboard their planes or conveyance. The contract in use by the airline and passenger shall constitute as the sole contract. Any other transportation, travel companies used shall have no responsibility or liability to any traveler aside from their liability as common carriers.
